Terms of Service

1. Acceptance

By using Upwarden, you agree to these Terms. If you do not agree, do not use the service.

You also confirm that you are at least 18 years old and that you have authority to accept these Terms on behalf of your organisation if applicable.

2. Service Description

Upwarden provides uptime monitoring, status page hosting, and incident management. We strive for high availability but do not guarantee 100% uptime.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account.

4. Acceptable Use

You may not use Upwarden to monitor targets you do not own or have permission to monitor. You may not use the service for DDoS amplification or any abusive purpose.

5. Payment

Paid plans are billed through Polar.sh. Subscriptions renew automatically. You may cancel at any time; access continues until the end of the billing period.

6. EU Consumer Rights

If you are a consumer in the EU/EEA, you have a 14-day withdrawal right from the date the subscription starts, unless your right has expired or a legal exception applies. To exercise this right, you must send a clear e-mail to [email protected] before the withdrawal period ends, including your account email and subscription details.

Upon valid withdrawal, we will confirm cancellation and process any mandatory refunds for paid amounts in accordance with applicable consumer law and your payment terms.

7. Liability

Upwarden is provided "as is" to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages. To the extent we are liable, our total liability is limited to the fees paid for the most recent twelve-month period, except where law does not allow such a limit.

8. Termination

We may suspend or terminate accounts that violate these terms or misuse the service. You may delete your account at any time. Upon account deletion, paid subscriptions for future billing periods are canceled going forward and access continues until the end of the current billing period.

9. Governing Law

These Terms are governed by the law of Germany. If your local consumer protection laws provide stronger rights that are mandatory for the marketplace, those rights remain applicable. Any disputes that are not excluded by mandatory local law will be handled by the competent courts at the place where Upwarden is based.
